Terms & Conditions

These Terms & Conditions (“Agreement”) govern all rentals and services provided by Soft Play Westchester. By booking with us, the client (“you”) agrees to the terms below.
 

1. Booking & Payment

  • A signed agreement and deposit/full payment are required to reserve your date.

  • Full payment is due no later than [X days] before the event.

  • We accept online payments through secure third-party processors.

  • Your reservation is not confirmed until payment is received.
     

2. Cancellations & Rescheduling

  • Deposits are non-refundable.

  • Cancellations made within [7 days] of the event will be charged the full rental amount.

  • You may reschedule once, subject to availability, if notice is provided at least [7 days] in advance.

  • Weather-related reschedules are handled case-by-case for outdoor events.
     

3. Setup Requirements

Client agrees to provide:

  • Clear access to the setup area

  • A flat, clean surface

  • Adequate space for the rented items

  • Protection from extreme weather for outdoor events

We reserve the right to refuse setup if conditions are unsafe, unclean, or do not match the booking description. No refunds will be issued in those cases.
 

4. Supervision & Safety

  • Adult supervision is required at all times.

  • Our equipment is designed for toddlers and young children only.

  • No shoes, food, drinks, or sharp objects are permitted on the equipment.

  • Client is responsible for enforcing all safety rules during the event.
     

5. Use of Equipment

Client agrees that:

  • Equipment will be used only for its intended purpose.

  • No moving or rearranging equipment without permission.

  • Any damage, loss, or excessive cleaning required will be billed to the client.

Client assumes full responsibility for all participants using the equipment.
 

6. Damage & Cleaning Fees

Client will be charged for:

  • Damage beyond normal wear and tear

  • Stains, slime, paint, confetti, or bodily fluids

  • Missing equipment

  • Excessive cleaning required

Fees will be assessed after pickup and charged to the card on file.
 

7. Liability & Assumption of Risk

Soft Play Westchester is not responsible for injuries, accidents, or damages that occur during the rental period.

By booking, client assumes all risks associated with the use of the equipment and releases Soft Play Westchester from any claims, liability, or legal action arising from participation.

A signed waiver may be required prior to setup.
 

8. Weather Policy (Outdoor Events)

  • Client is responsible for monitoring weather conditions.

  • We do not set up in rain, high winds, extreme heat, or unsafe conditions.

  • If conditions are unsafe, we may cancel or reschedule at our discretion.
     

9. Photography & Marketing

Unless otherwise requested in writing, Soft Play Westchester may use photos taken at your event for marketing and social media without identifying personal information.
 

10. Force Majeure

We are not liable for failure to perform due to circumstances beyond our control including natural disasters, illness, government restrictions, or emergencies.
 

11. Indemnification

Client agrees to indemnify and hold harmless Soft Play Westchester from any claims, damages, losses, or expenses arising from the rental and use of equipment.
 

12. Governing Law

This Agreement shall be governed by the laws of the State of New York.
 

13. Agreement Acceptance

By booking with Soft Play Westchester, client acknowledges they have read, understood, and agree to these Terms & Conditions.
